The following will outline Terms Of Service for Commissions, Your Character Heres (YCH) and Adopts.

The following is a legally binding agreement between me, the artist, and you, the buyer that establishes usage and rights. All clients are to read my TOS. By commissioning me, you are agreeing to have read and consented to these terms.

CREDIT
No matter what type of work you are receiving from me, proper credit is required for each one. Proper credit includes either tagging me in the post where art is used or writing my username (eno4here) as the artist in the caption/comments. Credit is not required with every post art is used, only the first initial post.
"credit to artist" is not a proper form of credit

Commercial Fees
Commercial fees are for those commissioning work to be used as a future product, this includes both digital and physical items/promotion. If you are a commercial client please refer to the commercial commission terms of service here
Who is this for?
✦︎ If you commissioning a vtube model with the intent of producing content for a brand, monetization or merchandise, you need to read the commercial TOS
✦︎ If you are commissioning artwork to be sold to others, used in promotional material, or anything that falls under earning revenue, you need to read the commercial TOS
note : If you are a College/University club or local organization and we've made private arrangements, the commercial TOS still needs to be read.-------------
1. Non_Commercial Fees
The following terms of service beyond this point it only taking into account non-commercial (everyday buyer) fees and services
✦︎ Non Commercial Buyers are those purchasing commissions for personal (not monetized) intent2. Payment
A full payment is requested via PayPal after a sketch is presented. All prices are in USD.
note : payment is made using a business account to prevent fraud3. Refunds
Refunds will not be granted after work is completed or nearing completion (ie. rendering near finish).Refunds requested during the commission process will be granted with a percentage take away dependent on the stage of the commission
EX :
Linework done - 20%
Flat Color done - 40%
Mid-Rendering - 60%
note : along with the cut refund you will recieve the work where it is at.4. Revisions
There are no revision limits up until final work is agreed upon and received.5. Turn Around Time
My average turn around time for commissions is about 1-3 weeks. If something unexpected occurs in my personal life that prevents me from meeting that deadline, it is my job as the artist to be in communication and relay that information to the commissioner, and provide them with a new estimated delivery time.6. Commissioner Rights
As the commissioner you are free to use the art in any personal ways, except for the following :
✦︎ Commissioners may not claim art as their own creation.
✦︎ Please do not use/feed my art into any AI generation databases, (this includes both image and chat AI databases) or NFTs.
✦︎ Do not remove, modify, or cover my signature.7. Artist/Creator Rights
As the artist I have the right to use any and all work for promotional material, media posts, and portfolio pieces.8. Service Rights
As the artist, I have the right to refuse service for any reason but the reason for refusal will be conveyed with the commissioner.Cancellation of a project may occur if and not limited to : issues with payment, harassment, violation of terms of service. Warning of violations will be given twice before the project is terminated.Terminated projects over harassment or inappropriate behavior will not be refunded. Commissioner will be warned if behavior falls into that category prior to termination.Terms of Service are subjected to change

YCH Terms Of Service

1. Re-occurring YCHs
There are two types of re-occurring YCH commissions I do yearly. The following are the re-occuring YCH types I do each year.I. Pride Month YCHs [June]
II. Spooky YCHs [October]Both of these types are year-locked and the YCH of one year will not be brought back the following year.2. YCH Holds
You may request a hold on a YCH by messaging me. There is a limit of two holds per YCH.
Holds are non-binding agreements that allow a buyer time to decide if they would like to go through with the purchase.
note : Holds do not last outside of the YCH window, if a YCH closes after a month, a hold will not allow for the buyer to request it after said month. Those that have a hold on a YCH that is about to expire will be contacted prior to it's end3. Payment
A full payment is requested via PayPal to receive the final work.

Refunds will not be granted for YCHs due to their quick turn around time5. Revisions
There are no revision limits up until final work is agreed upon and received. Small revisions such as eyes or color are allowed after work is delivered. Large revision such as poses or character are not offered once work is delivered6. Turn Around Time

Adopt Terms Of Service

1. Payment

Refunds will not be granted for Adopts3. Buyer Rights
By purchasing the design/character, you are allowed the full customization of said character however buyer should acknowledge the change as the modified version and not the original design.4. Buyers May Not
✦︎ claim character as their own creation. (even if modified, original credit should still be given)
✦︎ feed character into any AI generation databases, (this includes both image and chat AI databases) or NFTs.
✦︎ Deny Credit in public posts7. Artist/Creator Rights
As the artist I do not use purchased adopts in promotional material or media posts. However, I have the right to use work for portfolio pieces, unless requested not to by buyer6. Service Rights

Commercial Commission Terms of Service

The following is a legally binding agreement between me, the artist, and you, the buyer that establishes commercial usage and rights in regards to both digital and physical goods. By commissioning me for commercial goods, you are agreeing to have read and consented to these terms. The bottom of this page will include a pdf version of these Terms that should be signed by both me, the artist, and you, the buyer before any negotiation or work begins. Commercial Fees
The following will showcase commercial fees charged based on the buyer's status.I. Individual Status
✦︎ Digital : +30% of original commission price
✦︎ Physical : +60% of original priceII. Brand Status
✦︎ Digital : +50% of original commission price
✦︎ Physical : +100% of original price-------------
1. Individual Status
Independent creators/individuals who are not backed, managed or employed by an organization, brand, or industry
note : this is not talking about sponsors, brand partnerships or creating videos using a company owned platform, this is specifically talking about a creator consciously managed by a brand or company.*2. Brand Status
creators/individuals who are backed, managed or employed by an organization, brand, or industry3. Payment
Half payment is required up front for work to begin and the other half of the payment is due to receive the final work.
Payment method varies depending on the relationship of the deal/request.
Individuals are delegated to pay via PayPal. All prices are in USD.
note : payment is made using a business account to prevent fraud4. Refunds
Refunds will not be granted after agreement is made and work begins. Failure to make second payment will result in the final work being undelivered.!! If the work is a vtube model and there is a failure to pay without any update or communication, the model will be sold5. Revisions
There are no revision limits up until final work is agreed upon and received.6. Turn Around Time
Turn around time varies from client to client and will be discussed privately.7. Commissioner Rights
As the commissioner of a commercial purchase you are free to use the art for monetary gain as privately discussed and agreed upon, except for the following :✦︎ Commissioners may not claim art as their own creation.
✦︎ Please do not use/feed my art into any AI generation databases, (this includes both image and chat AI databases) or NFTs.8.Watermark/Credit Logo
Commercial commissions, depending on agreement may or may not have my name physically attached to the product, however it is still the buyers responsibility upon this agreement that I (eno4here) must be credited as the artists and in the case of vtube models credited as the artists and rigger.If it was not agreed upon do not remove, modify, or cover my signature.9. Artist/Creator Rights
As the artist I have the right to use any and all work for promotional material, media posts, and portfolio pieces unless requested otherwise by the client.If it is a vtube model that wishes to remain hidden until debut, as the creator I will refrain from posting any information regarding the model until given explicit permission.10. Service Rights
As the artist, I have the right to refuse service for any reason but the reason for refusal will be conveyed with the buyer.Cancellation of a project may occur if and not limited to : issues with payment, harassment, violation of terms of service. Warning of violations will be given twice before the project is terminated.Terminated projects over harassment or inappropriate behavior will not be refunded. Commissioner will be warned if behavior falls into that category prior to termination.Terms of Service are subjected to change. Buyers are required only to follow the Terms of Service written in contract at the time of the signature.
